Nursing Home Abuse Attorney

What Steps Should be Taken When Meeting with a Tennessee Nursing Home Abuse Attorney?

Nursing home abuse and neglect claims and lawsuits are a very delicate and important process. In order to make sure that your claim of the suspected abuse or neglect of a Tennessee nursing home resident is investigated, there are a number of important steps that need to be followed before meeting with your nursing home abuse lawyer. These steps help to ensure that both you as a client and your attorney completely understand the whole picture in your case.

Steps Taken Before Meeting with Your Attorney:

  • You should be able to clearly show your familial or professional relationship with the resident. Your attorney will need to know why you are bringing the action on behalf of the person in the nursing home. What type of relationship do you have with the resident.
  • You should also be aware of whether you have a documented power of attorney authorizing you to make health care and other decisions for the resident.
  • In addition, you should be aware whether there is an appointed executor or administrator of the estate of the resident (i.e. if the victim is deceased).
  • Another factor that you should be aware of if whether all siblings and other beneficiaries are aware of your concerns regarding the resident’s care and whether they are willing to help in the pursuit of a claim on the resident’s behalf.  These cases are difficult so a unified family is very helpful.
  • You should discuss with your attorney whether there are any disputes or disagreements about the nursing home care abuse or neglect.
  • You should also bring copies of any legal documents of your authority to take legal action should be taken to the meeting.
  • If an arbitration agreement was signed at the nursing home bring a copy if you have one.
