Mario Batali’s Restaurant Del Posto Settles Overtime pay Case for $1.15 Million

Over the past few years restaurants here in Tennessee and across the country have moved toward earth friendly and local conscious business structures. Unfortunately, this has not always translated to treating their employees with the same respect. We have see a big rise on Tennessee restaurant tip pool violations and overtime violations over the past year. It is appears this problem is appearing across the country at some of the most successful restaurants.

According to this case, the Del Posto restaurant workers filed a lawsuit against the restaurant in October of 2008 alleging that the restaurant deprived them of part of their tips and overtime pay. According to The Restaurant Opportunities Center of New York, an advocacy group that had been working with the thirty-one employees, Del Posto denied the allegations.

The settlement with the Del Posto restaurant gives the employees $1.5 million and paid vacations and sick leave. The settlement will give the employees three paid sick days and five paid vacation days per year. Also the settlement stated that, employees who get vacation or sick days approved aren’t responsible for finding people to work for them in their absence. According to the advocacy group, Del Posto has also agreed to work with the High Road Employer program, which looks at improving restaurant working conditions. Del Posto declined to comment on the settlement.
