There are a few exceptions to dog bite liability, however. A dog bite victim may not have a case if:

  • The dog is a military or police dog acting in its official duty
  • The victim was alarming, enticing, or otherwise harassing the dog
  • The dog was protecting the owner from the other part, or that person’s dog
  • the dog was otherwise secured in a crate, kennel, or other enclosure
