Home Health Agency Settles Overtime Pay Lawsuit for $1.1 Million

A new overtime settlement has been reached with 1,500 home health aides. The aides will share in a $1.1 million settlement in their class action suit which claimed their employer failed to pay them overtime despite working sixty hours a week for several weeks. Current and former employees of the home health agency will each receive a share of the settlement based on their overtime hours that they failed to receive pay for as required by state law. The settlement will also prohibit the home health agency from retaliating against employees who complain about hours and wages. It also requires the company to appoint an administrator to deal with complaints about wages or the reimbursement of expenses.

According to research by the state Department of Labor, home health aide work is one of the fasting growing occupations in the state, however, the average salary is under $21,000. According to a survey by a National Employment project, almost eight-three percent of home health aides surveyed have reported overtime violations and eighty-four percent said they have worked “off the clock” without receiving the appropriate pay.
