Four Employees File a Lawsuit against Car Wash over Overtime Pay

According to this case, the family who the four employees filed a lawsuit against owns three car washes. The lawsuit claims that the Damavandi family did not pay its employees overtime or allow time for proper breaks for water and lunch. One of the employees, Marcial Hernandez, states that, he often worked fifty hours a week and was paid for forty.

This lawsuit is one in a series of lawsuits filed for car wash employees since 2008 in an attempt by unions and immigrant advocates to improve conditions. The Mexican American Legal Defense and Education Fund filed a class action lawsuit for the four car wash employees claiming that the Damavandi family made employees arrive early but only clock in when there were enough cars to wash.

It is expected that at least more than one hundred former and current employees will be part of the class action lawsuit, making unpaid wage damages to be well “into seven figures”, according to the lawsuit.
