City Gear Clothing Retailer Faces Lawsuit for Denying Overtime Pay

In Tennessee and all across the United States most employees are entitled by law to receive overtime pay if they work more than forty hours in a single work week. A recent case in the news involves, Denithia Pendergrass of Nashville and Alena Kelley of Lewisville, Texas who both work or have worked in management positions at stores run by City Gear LLC claim that the company requires its managers and assistant managers to work a minimum of forty-five hours each week but does not pay them overtime pay for the additional hours worked.

According to the company, they consider those employees to be exempt from overtime pay consideration because of their supervisory role, an acceptable practice under the Fair Labor Standards Act. However, City Gear LLC has failed to comply with the federal regulation by paying those employees a fixed salary, as stated in the lawsuit. This practice has been going on since 2009 according to the lawsuit.

The lawsuit is proposing to become a class action on the behalf of all the managers and assistant managers at City Gear stores, Marty’s, Deveroes, CGP, Holliday’s and The Vault. City Gear operates stores on Gallatin Road in Nashville and in the Hickory Hollow and Rivergate malls. The class action lawsuit could grow to about two hundred current and former City Gear employees. The lawsuit is seeking nearly $25 million in compensatory and liquidated damages for unpaid overtime and other penalties.
