Chipotle Faces Lawsuit over Failing to pay Overtime

In a recent overtime pay class action lawsuit, an employee claims that the Mexican grill chain failed to pay overtime pay to hundreds of employees. The lawsuit filed by Plaintiff Maxcimo Scott alleges that the chain misclassified its “apprentice” employees as managerial employees who are salaried and do not qualify for overtime pay. The lawsuit states that these “apprentice” employees receive a salary of $40,000 but frequently work more than forty hours a week performing tasks of hourly workers such as cooking and filling orders.

Scott, a general manager of a Chipotle, stated that he sometimes worked up to fifty-five hours a week as an apprentice. The lawsuit is seeking back pay and damages.
