Memphis Abilify Law Suits

Determine If You Have a Case. Contact us Today for a Free Case Review.

If you have been taking the drug Abilify, you should call our office right away. This drug, along with the generic Aripiprazole has proven to have a wide variety of side effects that were not initially disclosed. The most impactful is the inability to stop uncontrollable urges.

The FDA has now required Bristol-Myers Squibb to place a warning on Abilify that the drug can lead to uncontrollable urges that include eating too much, shopping in excess, compulsive sex and gambling.

How Abilify Works

An antidepressant medication, the drug creates a balance in the production of dopamine. The drug is a partial dopamine agonist in that it prevents the brain from creating too much dopamine so that normal chemical levels can be restored.

While effective for treating depression, schizophrenia, and bipolar disorder, it also has many side effects. You will find side effects with any drug but, in this case, the side effects were not disclosed to patients taking it.

Too Little, Too Late

Bristol-Myers Squibb should have disclosed to the public that Abilify could create uncontrollable urges, but they failed to do so. The FDA is requiring them to add the warning, but it is too late for those that have already suffered harm or financial loss. If you are one of them, you have the right to sue.

Suing for Damages

You have the right to sue anyone who was negligent or responsible for you becoming injured or suffering financial harm. To do so, you must prove negligence or fault for what happened.  In this case, Bristol-Myers Squibb, was negligent because they failed to disclose a side effect that they were allegedly aware of. Even if they did not understand the full extent of the issue, there are reported cases of compulsive behaviors leading back to 2002 and they did not update their warning label until forced to in 2016.

How much you can receive in a lawsuit will depend on the extent of your financial losses or how your pain and suffering negatively impacted your life. You could get money to pay for:

  • Lost wages due to needing to take time off of work or even losing your job.
  • Money lost due to gambling it away or shopping too much.
  • Losses suffered as a result of any compulsive habit, whether eating too much or shopping.
  • Negative and costly lifestyle changes due to compulsive sexual behaviors.
Don’t Wait

It is important that you speak with an attorney and file a lawsuit as quickly as possible.  In Tennessee, there is a statute of limitations which says that you only have one year to file a lawsuit against a negligent party. If you miss this deadline, you could lose the ability to seek financial damages in a court of law.
